Cap is there, real Brick chimney. Happens in the spring and fall mostly when we get the most rain and not using the fireplace. We had it inspected by three people and no-one found anything. But it still happens, I'll check the flashing and maybe seal the chimney.

Water in the firebox is usually coming fron the crown or cap. Flashing and issues with water absorbation in brick will generally show up in the ceiling next to the chimney chase.

Water getting into the fire box might be coming right down the middle of the clay liner since you say it is when heavy and wind driven rains happen mostly. Might consider putting a spark arrester cap over the liner pipe and then check to be sure the damper isn't totally rust rotted which should be stopping water from hitting center of the firebox.

ill check it out, when the weather gets better i plan on getting on the roof and using the hose to see if i can find the leaking spot.
