Staining Brick?

Hi there,
I'm new here and need some advice on a problem. I had my chimney rebuilt and the bricklayer promised a red brick to match the rest of the house, but before I knew it he started with a light rusty shade of brick. We exchanged words and he refused to change it. Even though I got a break on the price, I'm stuck with a noticeably different shade.
Can I stain it? Is waterproof better? Any suggestions on what to use?

Can you stain it yes, will it ever match, no way.
It will also come out blotchy and some will end up on the morter.
My guess is that was some left over brick he had laying around, very poor workmanship to do something like that. I would have ran him off and got someone else to do the job if that''s the kind of work he does.
