the previous owner cut out the metal mesh on my chimney cap for some reason i dont know. can i lay a mesh insect screen on top of the chimney than reinstall the cap?

I would wrap some new material around the outside and wire it on. The screen is mostly on those things to keep birds and such from thinking about roosting or building a nest.
 
I would use a galv. hardware cloth, because screen mesh is too fine and may cause debris from combustion to accumulate, and eventually obstruct flow.
 
I did that in our last house after a squirrel fell down the metal flue. It was fun getting him out without letting him loose in the house.
I had a squirrel in my fireplace chimney. The damper was closed so it couldn't get into the fireplace. I put a heavy rope down the chimney for it to climb out. I didn't see it come out, it may have been a flying squirrel and came out at night.

Our damper was closed, but we blocked off the family room from the rest of the house best we could, opened the two exterior doors and opened the damper. He didn't waste time finding an open door.
 
i have alot of trees around me, my gutters get constantly clogged. i am just afraid debris will get into my chimney. the chimney flue is for a water heater/furnace/ac so there is no creosote. can i still put a metal mesh. is it also ok to lay it flat instead of install a standard cap because the standard ones arent fine. i know the standard is 1/2" opening but my gutters get constantly clogged with fine debris and im afraid it will be the same for my chimney. there are also mice in my house and they can fit in tiny spaces.

Install gutter guards to keep the debris out. It sounds like you have the same problem with fine debris that I had so don't even consider the ones with wide openings (i.e. 1/8 - 1/16 inch). I tried six different ones, everything from cheap vinyl to stainless steel, and finally settled on Best-1 gutter guards. They cost about $2.50/ft at HD but were easiest to install for my gutter/roof configuration. Try installing a sample piece (samples from manufacturer were at most a few bucks, one was free) before you buy the lot. One style would not work at all for me.
