Bath tub Drain not stopping water 100% to fill tub

Ok we are installing a new wirlpool tub. it is a drop in.

Put on the new drain and such on to the tub. we are using the old style drain stopper. the one where you flip the lever and it drops the stopper into the "T".

My question is I went to test I dumped in about 2 gallons on water and it slowly trickled out the drain.

I can reach my finger up and I feel the stopper resting on the bottom of the "T". Also was very careful not to get any PVC glue in there to affect this.

The only thing I was wondering was will a full tub provide more pressure against the stopper and create a better seal?

Guess if I can not get this to work I will switch out the strainer for one of the screw in stoppers
 
That's not all that uncommon with plastic drains. Probably a burr or mold line in the way.

I prefer the Gerber brass drains myself...
 
Ok then and yes looked at brass but it was like $25 more. Guess I will invest in a screw shut stopper instead. Almost did the 1st time and should have.
