We have a two faucet setup in our bath/shower. We just had it replaced with a newer Moen unit. After the install I went to take a bath and noticed we still had water coming from the shower head. I just replaced the Tup Spout diverted with Menards brand and now have more water coming from shower head, put the initial Moen back on and it still has a substantial amount of water coming from shower head when it the Diverter is to be shutting it off. Don't get it, it's a simple device, is there a trick here or is the new stuff just junk.
 
Try it with the tub spout removed. If the results are unchanged then the problem may be with the water pressure, the size of the tub spout nipple or a restriction in the valve.
 
Check for a clogged pipe (behind the shower wall) from the tub faucet down to the spout.

Spout diverters work via gravity. In the "shower" position the spout opening is blocked. In the "tub" position only gravity keeps water from going up to the shower.
 
A partially clogged spout should act this way with any diverter.
Can you see a clog in the spout?
