Issue with bathroom light/fan switch

I recently open up the existing light/fan switch that was in my bathroom to replace it with a newer switch. I put the wires onto the new switch exactly how they came off of the old switch and when i turned on the switch the breaker would trip. Turned out there were two wires joined together via what I believe was a t-splice using a metal crimp although I'm not positive. This conjoined wire apparently had broken thus leaving me with only the crimped part at the tip; therefore, I had to cut the crimp off and now I'm stuck with two wires that used to be one.

1) I'm not sure if this was/is legal since this house was built in the 70's.
2) I dont know if 'crimping' the wire for the t-splice would be what I need to do fix my switch or if there is any other way I could wire the switch without having to do a splice.

Any suggestions or is what I'm describing not clear enough??

Take the two wires and third 6inch pigtail and put them together with a wire nut. Use new short pigtail to connect to the spot where the other wire was.
