Gutters too low

I have uploaded pictures of my old gutters and new gutters.

The old gutters were installed 40 years ago when the condo was built. The old gutters were attached to the sheet metal and the upper fascia boards were covered by the old gutters.

The new gutters aren't attached to the sheet metal and the upper fascia boards are open to the weather. Are the new gutters installed correctly? Should I ask the contractor to raise the gutters? Or should I ask the contractor to paint the upper fascia boards?
